Scope of Products

Blueberry & Banner provides original cross stitch designs and related products, including but not limited to:

  • Digital cross stitch patterns in PDF format
  • Printable pattern files
  • Physical printed patterns made to order
  • Cross stitch kits where available

Products may be delivered digitally or physically depending on the individual listing.

International Sales

Digital Products

Digital products are available worldwide.

By purchasing from our Site, you acknowledge and agree that:

  • All transactions are processed within the United States
  • These Terms are governed by United States law

Physical Products

At this time, physical products are shipped within the United States only.

International shipping is not currently available for physical items.

Orders placed outside supported shipping regions may be canceled at our discretion.

Digital Product Delivery

Digital products may be delivered through:

  • Instant download access
  • Email delivery
  • Secure account or access links

You are responsible for:

  • Downloading and saving purchased files
  • Maintaining access to your digital products
  • Ensuring compatibility with PDF-reading software or devices

We are not responsible for:

  • Lost files after successful delivery
  • User error when accessing downloads
  • Device or software compatibility issues

No Refund Policy

All sales are final.

Due to the nature of digital products, refunds, returns, or exchanges are not offered except where specifically outlined in our Refunds & Returns Policy.

By completing a purchase, you acknowledge and agree to this policy.

Payment Disputes & Chargebacks

By purchasing from our Site, you agree not to initiate chargebacks or payment disputes for products that have been successfully delivered or accessed.

In the event of a dispute, we reserve the right to provide documentation including proof of purchase, file delivery, and download access records.

Fraudulent disputes may result in:

  • Revocation of access without refund
  • Permanent restriction from future purchases
  • Additional action where legally appropriate

License & Usage

All patterns are sold under a limited, non-transferable license. Purchasing a pattern grants permission to use the design — not ownership of the intellectual property itself.

You may:

  • Use the pattern for personal stitching projects
  • Create finished stitched items for personal use or limited small-scale sale

You may not:

  • Share, distribute, or trade pattern files
  • Upload patterns to websites, marketplaces, or file-sharing platforms
  • Resell patterns in digital or physical form
  • Reproduce patterns for redistribution
  • Claim the design as your own work

Each purchase is licensed to a single individual only.

Violation of this license may result in revocation of access, purchase restrictions, or additional legal action where appropriate.

Intellectual Property

All designs, patterns, artwork, graphics, and written content remain the exclusive property of Blueberry & Banner and are protected under United States copyright law.

Purchase of a product does not transfer ownership rights.

Unauthorized use includes, but is not limited to:

  • Copying or reproducing designs
  • Sharing or redistributing pattern files
  • Uploading patterns to public or private platforms
  • Selling or distributing the designs without authorization

Blueberry & Banner reserves the right to:

  • Issue DMCA takedown notices
  • Revoke access to products
  • Pursue legal action where appropriate

Physical Products

Printed patterns and physical kits are made to order.

Typical processing time is approximately 3–7 business days before shipment.

All physical product sales are considered final.

Returns, exchanges, and cancellations are not guaranteed once processing has begun.

If a shipment arrives damaged, customers must contact us within 7 days of delivery and provide clear photographs of the damage.

Any resolution will be reviewed and determined at our discretion.

Product Representation

We make reasonable efforts to display products and designs as accurately as possible.

However:

  • Colors may vary depending on screen settings or printing methods
  • Finished stitched results may vary based on materials and stitching techniques
  • Mockups are provided for visual representation only

We are not responsible for variations in final stitched appearance.

Limitation of Liability

To the fullest extent permitted by law, Blueberry & Banner shall not be liable for:

  • Errors made during stitching
  • Loss of materials or project time
  • Outcomes resulting from use of our patterns or products

Use of our products is at your own discretion and risk.

Governing Law

These Terms are governed by the laws of the State of Oklahoma, United States.

Changes to These Terms

We reserve the right to update these Terms at any time.

Continued use of the Site constitutes acceptance of any revised Terms.
